Update: Dr. Gassan Sharif Khaled’s second abduction and subsequent imposing of a six months administrative arrest by the IDF/Shabak

Dr. Gassan Sharif Khaled is a professor of international commercial law at A-Najah University in Nablus, and the son of our close friend Abu Azzam. (http://www2.najah.edu/nnu_portal/index.php?page=95).
Dr. Khaled was abducted from his home in Nablus by the IDF on January 16th/08 and imprisoned for two months; the initial three weeks included interrogation by the Shabak (Israeli Secret Service) that included continuous physical torture (due to which he also suffered internal hemorrhage in one leg).
The allegations the Shabak presented are clearly baseless if not ridiculous; those acquainted with Dr. Khaled are certain that the whole affair is a sheer frame up. We know Dr. Khaled as a sworn adherent of non-violence, a man of truth, and a promoter of the Law in the greater sense.
Dr. Khaled was released from the Shabak’s prison following the initial two month arrest, due to what seemed then as the Shabak’s backing off from its accusations, realizing those could not be substantiated any more.
However just ten days following the release Dr. Khaled was again abducted from his home in Nablus in a very aggressive manner (soldiers broke in at 3:30 AM employing sledge hammers for shattering the doors of the building and his apartment), severely traumatizing his wife and five little children/babies.
Several military court hearings were held during the recent twenty days since he was re-cast behind bars: atypically even the military judge expressed his lack of understanding why this second abduction was necessary, and warned the Shabak of his intention to release Dr. Khaled within 24 hours if substantial “new facts” are not provided.
However the Shabak disagreed and the judge finally yielded, finally issuing an “administrative detention” decree for a six month period, based on the most ridiculous allegation that Dr. Khaled “was master planning a large scale military attack against the authorities” or something of the sort.
His excellent lawyer Att. Abid Mohammad will appeal to the High Court of Justice for the immediate release Dr. Khaled early this week: decision is expected within ten days at the most.
We, friends of the Dr. Khaled’s larger family (from the village of Jayyous near the besieged town of Qualqilia) – shall provide an update in few days.

עדכון: ד"ר רסאן שריף חאלד נחטף מחדש ע"י השב"כ לאחר ששוחרר לפני כחודש משני חדשי מעצר/חקירה/עינויים והוטל עליו מעצר אדמיניסטרטיבי למשך שישה חדשים.
ד"ר רסאן שריף חאלד מכהן כפרופסור למשפט מסחרי בינלאומי באוניברסיטת א-נג'אח בשכם, ובנו של חברינו הקרוב אבו עזאם (http://www2.najah.edu/nnu_portal/index.php?page=95)
ד"ר חאלד נחטף לראשונה מביתו ע"י צה"ל ב-16 בינואר2008 ונכלא למשך חדשיים, כשבשלושת השבועות הראשונים עבר חקירה תחת עינויים במרתפי השב"כ, שבעטייה נגרם ניזוק בגופו (בין היתר שטף דם פנימי ברגלו הימנית).
האישומים שהוטחו בו ע"י השב"כ הינם בבירור נטולי בסיס אם לא מגוחכים: אלו שהתוודעו לד"ר חאלד משוכנעים שמדובר בתפירת תיק ותו לא! אנו מעריכים אותו כחסיד מושבע של אי-אלימות, איש אמת וכמטפח מימד החוק במובן הגבוה ביותר.
לאחר שני חדשי המעצר הראשונים, ד"ר חאלד שוחרר מכלא השב"כ משום שכפי שאז ניתן היה להבין השב"כ נסוג מאישומיו משנוכח כי נמצאו חסרי ביסוס.
אלא שכעשרה ימים לאחר שחרורו שוב נחטף ד"ר חאלד באישון לילה מביתו בשכם (חיילים פרצו לביתו ב 03:30 תוך ניתוץ הדלתות לבניין ולדירתו בפטיש כבד) תוך גרימת טראומה קשה לאשתו ולילדיו הקטנים.
במהלך כעשרים הימים האחרונים מאז החטיפה השנייה, אותם בילה ד"ר חאלד מאחרי סורגים כלא הכיבוש, התנהלו מספר דיונים בבית הדין הצבאי בעניינו שבהם השופט ביטא בבירור את מסקנתו שבחומר "החקירה" הסודי שהוצג לפניו מחדש ע"י השב"כ לא נמצא כל פרט נוסף שהצדיק את החטיפה האחרונה. השופט התריע בפני נציג השב"כ שאם תוך 24 שעות לא יוצג לפני חשד מבוסס - ד"ר חאלד ישוחרר לאלתר.
אלא שהשב"כ מיאן להסכים לכך, והשופט נכנע לבסוף וחתם על צוו מעצר מנהלי לשישה חודשים בגין האישום שד"ר חאלד הינו – לא פחות - מ"המוח" מאחרי מזימה לתקיפה צבאית רחבת היקף על השליטה הישראלית בשטחים (או משהו אבסורדי בכוון...).
עורך דינו של ד"ר חאלד מר עבאד מוחמד יגיש (מחר, יום ב') לבג"צ עתירה לשחרורו המיידי של ד"ר חאלד: החלטה צפוייה להתקבל תוך מכסימום עשרה ימים.
